Personal Data
We also draw your attention to the letter from the Russian Federal Tax Service dated 09.09.2019 No. ПА-4-6/18073@, which explains the issue of the placement and processing of personal data contained in the EGRUL and EGRIP registers.
In this letter, the Federal Tax Service stated that in cases provided by law, the subject’s consent for personal data processing is not required. In 2019, the Federal Tax Service received a request concerning the information published on their website from EGRUL about organizations and individual entrepreneurs. Following this, the tax authorities issued a letter indicating that under the law, the data subject can revoke consent for their data processing (Part 2 of Article 9 of the Federal Law of 27.07.2006 No. 152-FZ), but in cases specified by law, the data operator may continue processing the information. If the law requires disclosure, the operator may disregard the revocation of consent.
The Federal Tax Service also reminded that the names and TIN of founders are public information. The same category includes the list of individuals authorized to act by proxy.
